What is a QDRO?

A Qualified Domestic Relations Order (QDRO) in Texas is a legal document that recognizes the right of an alternate payee (typically an ex-spouse or dependent) to receive all or a portion of the benefits under a retirement plan. QDROs are commonly used in divorce proceedings to divide retirement assets, such as 401(k) plans or pensions, in a way that complies with the Employee Retirement Income Security Act (ERISA) and is enforceable by the courts.

In Texas, the QDRO must meet certain requirements to be valid:

  1. Identification of the Plan: It must specify the name of the retirement plan and the participants’ details. It is very important to have this information so that your attorney will know what language is needed for your specific plan.
  2. Alternate Payee Information: It should clearly identify the alternate payee(s), which could be an ex-spouse or dependent children. Typically, the information needed is the full name of the alternate payee, date of birth, address, and social security number. The same information will be necessary for the participant as well. 
  3. Amount or Percentage: The order must state the amount or percentage of the benefits to be paid to the alternate payee. This is typically negotiated in mediation between the parties and their attorney.
  4. Timing of Payments: It should outline when the payments will begin and any other relevant payment details.
